REGULATIONS FOR THE PROVISION OF ELECTRONIC SERVICES BY KAKUMA RACING PARTS
Introductory provisions
These Regulations govern the provision of electronic services on the Kakuma Racing Parts website, defining the terms and conditions for the provision of Electronic Services by the Seller via the website www.kakumaracingparts.com to Customers.
Customer means an entity concluding a Service Agreement with the Seller, provided it has full legal capacity or limited legal capacity in cases regulated by applicable law, or being a legal person or organizational unit.
Consumer means a natural person concluding an Agreement not directly related to their business or professional activity.
Seller means Kakuma Racing Parts Ltd., with registered office at[Eleutheriou Venizelou 28 , Metamorfosi , 14452 , Athens ], Greece, Tax ID: [079839663] the service provider, administrator, and owner of the Store.
Store means the online store operated by the Seller in Greek via the website www.kakumaracingparts.com . The Store provides Electronic Services to Customers, including sales.
Electronic Service means a service provided by the Seller to the Customer based on an Agreement concluded between the parties via the Store, within an organized system of distance contracts, without the simultaneous physical presence of the parties.
Shopping Cart means a Store functionality allowing the Customer to complete orders for Products by adding them to the cart via the “Add to cart” button.
Sale means the provision of a service by the Seller to the Customer involving the sale of Products remotely, by transmitting data at the Customer’s individual request via electronic processing devices.
Contract means the contract for the provision of Electronic Services by the Seller to the Customer.
Seller’s Contact Details are the Seller’s contact data used by the Customer to contact the Seller, i.e., Kakuma Racing Parts Ltd.,[Eleuteriou Venizelou 28 , 14452 , Greece] phone: [+30 6978905981], e-mail: [Info@kakumaracingparts.com].
Customer’s Contact Data means data provided by the Customer used by the Seller to contact the Customer, including address, e-mail, and telephone number.
Customer Account is a panel managing Customer orders, accessible after registration and login.
Registration means creating a Customer Account via the Store’s registration form.
Product means an item presented for Sale in the Store.
Delivery means delivering Products to the Customer’s indicated destination via a Carrier.
Carrier means an entity cooperating with the Seller to deliver Products.
External Payment System means an online payment system used by the Seller.
Working Days means Monday to Friday excluding public holidays in Greece.
§1 General terms and conditions of the contract
The Seller, pursuant to Greek law and applicable regulations regarding electronic services, establishes these Regulations available on the Store’s website at www.kakumaracingparts.com .
The Seller provides Electronic Services under these Regulations and applicable law.
The Regulations are made available at all times on the Store’s website for Customers to access, record, and reproduce.
Information on the Store’s website does not constitute a binding offer but invites Customers to submit offers to conclude Sales Agreements.
Electronic Services are provided 24/7 via the Store website.
§2 Terms of Use & Registration
Using the Store requires an internet-enabled device, a supported web browser, and an active e-mail account.
Registered Customers may access and manage their orders through their Customer Account. Registration is not required to place an order, where guest checkout is available.
Registration involves completing and submitting the registration form with truthful and complete Customer data.
Before completing registration, Customers must consent to the processing of their personal data in accordance with the Store’s Privacy Policy and accept these Terms and Conditions.
§3 Providing free Electronic services
The Seller provides certain free electronic services through the Store, including the contact form, order form, Customer account functionality, product reviews and Newsletter, where available.
The availability and functionality of these services may be modified, suspended or discontinued by the Seller at any time, particularly for maintenance, technical, security or operational reasons.
Customers must not use the Store or its electronic services to provide unlawful content, interfere with the operation or security of the Store, attempt unauthorized access, or use the services in a manner contrary to applicable law or these Terms and Conditions.
Customers may stop using the free electronic services at any time. Registered Customers may request the deletion of their Customer Account, subject to any data retention obligations required by applicable law.
§4 Orders
Orders may be placed 24/7 through the Store’s Cart function.
Customers may place an order either through a registered Customer Account or, where available, without registration using guest checkout.
Before confirming an order, Customers are required to provide the necessary billing and delivery information and select the available delivery and payment methods.
Orders can be modified or canceled until shipment. However, if a product has already been sent for anodizing in a color selected by the Customer, the product is considered a Custom Order. In such cases, cancellation may only be accepted with a partial refund, as the costs already incurred for the customization and anodizing process will be deducted from the refundable amount.
Products ordered in an anodized color other than the standard aluminum finish are considered Custom Orders. Where the product is in stock, the anodizing process normally requires an additional 2–5 business days, depending on the selected color. This processing time is additional to the estimated shipping/transit time.
Product availability displayed in the Store may change. If an ordered Product is unavailable or an order cannot be fulfilled, the Seller will inform the Customer as soon as reasonably possible.
Order confirmation is sent by e-mail and constitutes acceptance of the order by the Seller and conclusion of the Sales Agreement.
§5 Sale & DELIVERY
Sales Agreements involve the sale and delivery of Products ordered through the Store in accordance with these Terms and Conditions.
Products are shipped to the delivery address provided by the Customer using the available shipping method selected during checkout. The Customer is responsible for providing complete and accurate delivery information.
Delivery times displayed or communicated by the Seller are estimates and may be affected by the Carrier, customs clearance, public holidays, weather conditions, or other circumstances outside the Seller’s reasonable control.
For shipments outside the European Union, any applicable customs duties, import VAT, customs clearance fees, brokerage fees, or other import-related charges are the responsibility of the Customer and are not included in the Product or shipping price, unless explicitly stated otherwise.
The Customer is responsible for complying with any applicable import requirements in the destination country.
If a shipment is returned to the Seller due to an incorrect or incomplete delivery address provided by the Customer, refusal of delivery, failure to collect the shipment, or failure to pay applicable customs duties, taxes or import charges, any additional shipping, return or re-shipping costs may be deducted from any refundable amount or charged to the Customer.
Risk of loss or damage passes to the Consumer upon delivery of the Products to the Consumer or to a third party designated by the Consumer, other than the Carrier.
Customers should inspect the shipment upon delivery. Any visible damage to the packaging or Products should be reported to the Carrier and to the Seller as soon as possible, preferably accompanied by photographs of the packaging and the damaged Product.
§6 Payment
Product prices displayed in the Store are shown excluding VAT, unless otherwise stated.
Any applicable VAT is calculated during checkout according to the Customer’s billing and/or delivery country and the applicable tax regulations.
For eligible business Customers established within the European Union, VAT may not be charged where a valid EU VAT identification number is provided and the applicable requirements for an intra-Community supply are met.
Customers outside the European Union may not be charged Greek VAT. Any import VAT, customs duties, clearance fees or other charges imposed in the destination country are the responsibility of the Customer, as described in §5.
Shipping costs are calculated separately and displayed during checkout before the order is confirmed.
The total amount payable by the Customer, including any applicable VAT and shipping charges, is displayed before the order is confirmed.
Available payment methods are displayed during checkout and may vary depending on the Customer’s country, order value or other applicable conditions.
Invoices and receipts are issued electronically in accordance with applicable Greek law.
Any refund due to the Customer will be processed using the original payment method, where possible, and in accordance with these Terms and Conditions and applicable law.
§7 Complaints and guarantees
Complaints concerning defective, damaged, incorrect or non-conforming Products should be submitted to the Seller in writing or electronically, together with the order number and, where reasonably required, photographs or other information necessary to assess the claim.
The Seller will review complaints and respond within the timeframe required by applicable law.
Consumers are entitled to the statutory remedies available under applicable Greek and European Union consumer law in the event of a lack of conformity of a Product. Nothing in these Terms and Conditions limits or excludes the Customer’s mandatory statutory rights.
Products must be installed correctly and in accordance with their intended application. Where professional installation is specified or reasonably required due to the nature of the Product, installation should be carried out by a suitably qualified person.
The Seller is not responsible for damage or failure resulting from incorrect installation, improper use, unauthorized modification of the Product, accident or collision damage, use of incompatible components, or use outside the Product’s intended application, except where liability cannot legally be excluded.
The Customer is responsible for verifying the suitability and compatibility of the Product with the specific vehicle, vehicle configuration and other components used, taking into account the compatibility information and installation requirements stated in the Product description.
Products intended for motorsport or racing applications may require modifications, adjustments, professional installation, alignment or additional compatible components as stated in the relevant Product description. The Customer is responsible for ensuring that the vehicle complies with applicable road, motorsport and safety regulations in the country in which it is used.
Any commercial guarantee provided by a manufacturer or distributor is additional to, and does not affect, the Consumer’s statutory rights.
Due to the nature of the anodizing process, minor variations in color, shade or finish may occur between different Products, components or production batches. Colors displayed in photographs or on screens may also differ slightly from the actual Product. Such minor variations, where they do not affect the functionality or intended use of the Product, are not considered defects.
§8 Withdrawal from the Agreement
Consumers have the right to withdraw from a distance Sales Agreement within 14 days, without giving any reason, subject to the exceptions provided by applicable law.
The withdrawal period expires 14 days after the day on which the Consumer, or a third party designated by the Consumer other than the Carrier, takes physical possession of the Products.
To exercise the right of withdrawal, the Consumer must inform the Seller of the decision to withdraw by a clear statement sent by e-mail or other available written means before the withdrawal period expires.
The Consumer must return the Products without undue delay and no later than 14 days after informing the Seller of the withdrawal.
The direct cost of returning the Products is borne by the Consumer, unless otherwise agreed or required by applicable law.
The Consumer is responsible for any diminished value of the Products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
The Seller may withhold reimbursement until the returned Products have been received or until the Consumer provides evidence that the Products have been sent back, whichever occurs first.
Where the Consumer has expressly selected a delivery method more expensive than the least expensive standard delivery method offered by the Seller, the Seller is not required to reimburse the additional delivery cost.
The right of withdrawal does not apply to Products made to the Consumer’s specifications or clearly personalized, where the conditions for such an exception under applicable law are met. This may include Products manufactured or specifically modified according to individual specifications requested by the Consumer.
The above limitation does not affect the Consumer’s statutory rights concerning defective or non-conforming Products.
§9 Promotions and promotional campaigns
The Seller may offer promotional campaigns, discount codes, special offers or other promotions from time to time.
Each promotion may be subject to specific terms and conditions, including its duration, eligible Products, eligible Customers, minimum order value, geographical limitations or other restrictions, as specified at the time of the promotion.
Unless explicitly stated otherwise, promotional offers and discount codes cannot be combined with other discounts, promotional codes or special pricing.
Promotional codes have no cash value and cannot be exchanged for cash.
The Seller reserves the right to modify, suspend or terminate a promotional campaign where reasonably necessary, without affecting orders already validly concluded under the promotion.
In cases of misuse, fraud, technical error or unauthorized use of a promotional offer or discount code, the Seller reserves the right to refuse or cancel the promotional benefit, subject to applicable law.
§10 Supplementary provisions
All content available through the Store, including but not limited to text, photographs, graphics, logos, trademarks, product names, product descriptions, technical drawings, product designs and other materials, is protected by applicable intellectual property laws and belongs to the Seller or its respective rights holders.
No Store content may be copied, reproduced, modified, distributed, published or used for commercial purposes without the prior written permission of the Seller or the respective rights holder.
Customers must not submit or transmit through the Store any unlawful, harmful or infringing content or use the Store in a manner that may interfere with its operation, security or availability.
Customers are responsible for maintaining the confidentiality and security of their account credentials and for promptly informing the Seller of any suspected unauthorized use of their account.
The Seller may change Product prices, availability and promotional offers at any time. Such changes will not affect orders already validly concluded at the previously agreed price.
The Seller is not responsible for temporary interruptions or delays in the operation of the Store caused by maintenance, technical failures, internet or hosting provider failures, cyber incidents, force majeure events or other circumstances outside the Seller’s reasonable control, except where liability cannot be excluded under applicable law.
§11 Final provisions
The Seller uses cookies and processes personal data in compliance with applicable Greek and EU data protection laws.
Customers have rights to access, correct, and object to data processing.
Privacy policy and cookie policy are available on the Store’s website.
Commercial communications are sent only with Customer consent.
The Seller applies Greek law and relevant EU regulations.
In case of conflicts, Greek law provisions prevail.
§12 VAT INFORMATION
The application of VAT depends on the customer type and the country of establishment.
Sales to EU Businesses (B2B)
Sales of car spare parts and accessories to businesses established within the European Union are exempt from VAT, provided that the customer is a taxable business.
The invoice will include the following reference:
“VAT exempt – Article 33 of the VAT Code – Law 5144/2024.”
Sales to EU Private Customers (B2C)
Sales of car spare parts and accessories to private individuals within the European Union are subject to VAT at the applicable rate.
A retail receipt or an invoice may be issued accordingly.
Sales to Businesses Outside the EU (B2B – Third Countries)
Sales to businesses established outside the European Union (e.g. USA, Albania, etc.) are exempt from VAT, provided that the goods are exported under the official export procedures and an export declaration is submitted to the competent customs authority.
The invoice will include the reference:
“VAT exempt – Article 29 of the VAT Code – Law 5144/2024.”
Sales to Private Customers Outside the EU (B2C – Third Countries)
Sales to private individuals outside the European Union are also exempt from VAT, provided that export procedures are completed in accordance with Article 29 of the VAT Code – Law 5144/2024.
Due to the need for additional customer information (full name, delivery address, etc.), an invoice may be issued including the reference:
“VAT exempt – Article 29 of the VAT Code – Law 5144/2024.”
§13 CUSTOM ORDERS & ANODIZED COLORS
Any Product ordered in a specific anodized color other than the standard natural aluminum finish is considered a Custom Order.
For Products that are currently in stock, custom anodizing normally requires an additional 2–5 business days, depending on the selected color and the availability of the anodizing service.
The anodizing lead time is additional to the estimated shipping/transit time and applies before the order is dispatched.
Due to the nature of the anodizing process, minor variations in color, shade or finish may occur between different Products, components or production batches. Colors displayed in photographs or on screens may also differ slightly from the actual Product. Such minor variations do not constitute a defect, provided that they do not affect the functionality or intended use of the Product.
